1. Organiser

The organising company is Escuderia Nàutica S.L. (hereinafter "Club Nàutic Poblenou" or the "organiser"), with registered office in Sant Vicenç de Montalt, C/Can Patoi, 7, NIF number B42922542 (more information at www.clubnauticpoblenou.com), and is organising a competition or prize draw (hereinafter "the CONTEST/DRAW") under its responsibility and in accordance with the rules detailed below.

2. Eligibility requirements

Only people over 18 years of age with a residence in Spain (Peninsula and Balearic Islands) and who are not employed by Club Nàutic Poblenou can participate in this prize draw/contest. In order to participate, the participant must have an Instagram account. In addition, by participating in this competition/sweepstakes, the participant agrees to know and comply with the conditions of the Instragram social network.

3. Mechanics, prize and dates

The particular information about the contest/sweepstakes, i.e. the mechanics, the prize and the dates of the contest/sweepstakes and the communication of the winner are indicated in the post of the contest/sweepstakes itself.

4. Election of the winner

In the case of a prize draw, the winner will be chosen randomly by Club Nàutic Poblenou via the instagram.com/commentpicker.app platform from among all those who have entered the draw. In the event of a competition, the winner will be chosen by a jury made up of members of Club Nàutic Poblenou. Club Nàutic Poblenou will contact the winner to obtain the necessary details and to communicate the prize. By submitting their personal details, the winner expressly accepts the conditions of the promotions described in these rules of participation. In the event that a winner cannot be contacted within 15 days from the communication of the winner, the next participant in the ranking of selected/winners will be contacted.

5. Intellectual Property and Assignment of Image Rights

The winner of the competition/sweepstakes knows and consents to his/her full name and public Instagram/Facebook/Twitter/Pinterest profile photo being published by Club Nàutic Poblenou on all those social media profiles where the competition/sweepstakes has an account. In the case of the competition, participation in the competition implies the participant's consent for Club Nàutic Poblenou to reproduce, distribute and publicly communicate the photographic work generated in the course, always for purely informative purposes and in any case related to the competition.

6. Data protection

ESCUDERIA NAUTICA S.L, hereinafter RESPONSIBLE, is the party responsible for the processing of the User's personal data and informs you that this data will be processed in accordance with the provisions of current regulations on personal data protection, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data, for which reason you are provided with the following processing information:

Purpose of processing: to maintain a commercial relationship with the User. The operations envisaged to carry out the processing are:

- Sending commercial advertising communications, as long as it has been previously authorised, by email, Whastapp, SMS, social communities or any other electronic or physical means, present or future, that makes it possible to carry out commercial communications. These communications will be made by the RESPONSIBLE and related to its products and services, or those of its collaborators or suppliers with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.

- Conduct statistical studies.

- To process orders, requests or any type of request made by the user through any of the forms of contact made available to them.

- Send out the website newsletter.

Profiling: the RESPONSIBILITY may also carry out, with the consent of the User, profiling based on automated processing, aimed at evaluating the personal aspects provided by the Data Subject in order to carry out an analysis of his or her profile.

Intended consequences: The processing of the data does not foresee any consequences that could have any legal or other significant effect on the Data Subject.

Logic used: An automated procedure is used to process the data, where all the fields are filtered in order to obtain a result that fits your profile.

Data retention criteria: data will be retained for as long as there is a mutual interest in maintaining the purpose of the processing and when it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure the pseudonymisation of the data or the total destruction of the data. 7. Other rules of use

Offensive comments, insults, threats, foul language, degrading content or disqualifications towards other members of the community or towards our products and services, brands or staff will not be accepted.

8. Acceptance of the rules

The mere fact of participating in the competition/sweepstakes implies that the participant fully accepts the conditions of these legal bases. Likewise, participation in a sweepstake of this nature implies acceptance of the rules of the social network where the sweepstakes takes place.

9. Applicable law

These terms and conditions are subject to Spanish law. Any claim related to the draw must be sent in writing to Escuderia Nàutica S.L., Dpto. Jurídico, C/Can Patoi, 7 08394 Sant Vicenç de Montalt (Barcelona). In case of controversy in the application or interpretation of these rules and in the absence of an amicable agreement, all litigation will be subject to the courts of the city of Barcelona.
